LEGAL // TERMS OF SERVICE

Terms of Service

EFFECTIVE OCTOBER 20, 2026

These are the rules for using operateengineering.com and the OPERATE client portal. They are short on purpose. Consulting engagements have their own agreements, and those take precedence for the work itself.

01 //

Agreement

These terms are an agreement between you and Operate Engineering LLC, doing business as OPERATE. They apply to operateengineering.com and to the OPERATE client portal at portal.operateengineering.com. By using either, you accept them. Consulting and development work is governed by the written agreement for that engagement, and where the two differ, the engagement agreement controls for that work.

02 //

Who may use the portal

The portal is invitation only. Your organization adds you as a member, and you may use it only on that organization's behalf. There is no public sign-up. You must be at least 18 years old.

03 //

Your account

  • You sign in with a one-time code sent to your mobile number, or with a passkey you have registered. Keep your phone and devices secure. Anything done through your account is treated as done by you.
  • Tell us promptly if you believe someone else has used your account.
  • Your organization's administrator may deactivate your access at any time, and we may suspend access to protect the service or other users.

04 //

Acceptable use

Use the portal for its purpose: reporting bugs, feedback, and ideas about the software we build for your organization, and following their progress. Do not:

  • Upload content that is unlawful, that infringes someone else's rights, or that contains other people's private information without their permission.
  • Attempt to access another organization's data, probe or disrupt the service, or bypass its security.
  • Use the service to send unsolicited messages or for any purpose unrelated to your organization's engagement with us.

05 //

Your content

You keep ownership of what you submit. You give Operate Engineering LLC a license to store, display, and use your submissions to operate the portal, to build and improve the software for your organization, and to keep a record of the engagement. Your submissions are visible to the members of your organization and to OPERATE.

You are responsible for having the right to share what you upload, including photos and screen recordings.

06 //

Our materials

The portal, the website, and their design, code, and content belong to Operate Engineering LLC or its licensors. These terms do not transfer any of that to you. Ownership of software built under an engagement is set by that engagement's agreement.

07 //

Text messages

By being added to the portal with text notifications on, you agree to receive text messages about your reports. Message frequency varies and message and data rates may apply. You can turn texts off per report in the portal or reply STOP at any time. Reply HELP for help. See the Privacy Policy for details.

08 //

Availability and changes

The portal is a working tool that we improve continuously, and it may change, pause, or be withdrawn without notice. We do not promise that it will be available at all times or free of errors. We may update these terms, and continued use after a change means you accept the updated terms.

09 //

Disclaimers

The website and portal are provided as is and as available, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing on the website is professional advice for your specific situation.

10 //

Limitation of liability

To the fullest extent permitted by law, Operate Engineering LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business, arising from use of the website or portal. Our total liability for claims relating to the website or portal is limited to one hundred dollars. Liability relating to consulting or development work is governed by the engagement agreement for that work.

11 //

Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. Disputes will be brought in the state or federal courts located in Texas, and you consent to their jurisdiction.
